The Court of Justice of the European Union ruled on Thursday that streaming providers cannot blanket-exclude consumers' right of withdrawal from digital subscription contracts, bolstering subscriber protections across the bloc.
The case centered on Sky Österreich, brought by an Austrian consumer protection association. The court classified streaming subscriptions as digital services rather than content delivery, reasoning that platforms like Sky tailor offerings to user behavior and provide personalized recommendations. Subscribers must receive a reasonable cooling-off period after signing up, the judges held.
Customers who exercise the right of withdrawal must still pay compensation proportional to the duration and economic value of the content they consumed before cancelling. Tim Wittwer, a lawyer based in Hanover, noted that the ruling's requirements are equally applicable in Germany, signaling broad implications for Europe's streaming market.
