Lawyers for Andrew and Tristan Tate asked a U.S. judge on Friday to release the brothers on bail from a Miami jail, where they have been held for 20 days pending extradition to Britain. The defence argued the pair's extraordinary public profile would make flight practically impossible, proposing conditions including passport surrender and location monitoring.
U.S. prosecutors oppose the release, citing community risk and a high probability of flight. Judge Lauren Louis scheduled a hearing for August 13 to decide whether the brothers remain detained during extradition proceedings. Prosecutors are due to respond to the bail motion by August 10.
The Tate brothers were arrested in Miami on July 18 after a British judge issued an arrest warrant in January 2024. The Crown Prosecution Service announced on July 19 a total of 38 additional charges — including rape, sexual trafficking and assault — relating to alleged offences between 2010 and 2017. The UK has until September 16 to submit its full extradition request to the U.S. State Department.
